Includes preparation of the land trust agreement and placing the deed into trustee, plus the first 12 months of trustee services. Recording fees are extra and are subject to the presiding jurisdiction. If there are more than two beneficiaries, more than one parcel of land is in a trust, the property in trust is worth more than $2 million, or if the trust is named something unrelated to the property’s address, additional fees will apply. If you would like to consult with the attorney about the set up or anything else related to land trusts, you may do so for an additional fee.
This is billed annually during the anniversary month of the trust and covers our costs of time spent receiving and forwarding mail, and executing routine documents (contracts, notices of commencement, permit applications, leases, etc.). This fee is multiplied by the number of parcels of property included in the trust if more than one parcel.
Charged whenever the real property is conveyed out of the land trust.
Charged whenever the trustee coordinates execution of documents for refinances or a sale of trust property with law firms or title agents.

Charged each time a beneficiary assigns all or a portion of the beneficiary's interest to someone else.
If you are setting up a trust in the seller's name to be assigned to you at closing to hide the purchase price, or if you are assigning your existing trust to a buyer, we prepare the assignment, two Form 56s (terminate seller, initiate buyer), explanatory letter to the closing agent, and provide Forms DR-228 and DR-430 with explanation.
If requested, we will record a document on the Official Records, electronically where possible, and e-mail the recorded document to you. Recording fees are additional.

Many clients purchase properties at mortgage foreclosure auctions and tax deed auctions. It is best, if possible, to take title at the auction directly into a land trust so that your name never appears in public records, and so that any problems with the property won't attach to your by mistake. Complete this form at such auctions to tell the clerk how to title the property you're purchasing
We will not take any action as trustee on a beneficiary's behalf without written direction from the beneficiary. That written direction may be electronic (email, text message, fax, etc.) but in more formal situations such as purchases and sales, we require this form to be completed, signed and returned to us before we can proceed.
